TERMS AND CONDITIONS
Entrant – Any person/ or persons who enters the competition giveaway through the website to win the prize.
Prizes – The promoters ( Raffle23.ie ) can operate more than one competition at a time, and each competition will have unique prizes.
Winner – The winner (entrant) chosen at random on or after the closing date who will receive the prize/ prizes in accordance with these terms and conditions.
Entries into each competition – The entrants must answer a qualifying question using their own expertise and knowledge. The questions must be correct to the promoter answer. If the question is entered correctly the entrant will qualify for entry and will gain an opportunity to win the unique prize/ prizes for that specific competition. The correct answer must be presented for each question, the specified competition entry fee is due at this stage. Fees are in Euros and can be made either by the entrant or on behalf of the entrant.
Maximum number of entries: The maximum number of entrants for each competition will be clearly stated on the specific competition details. When the specific competition reaches its maximum sell out, the date for the live draw will be announced within 48 hours. If the competition does not reach the maximum required number of entries the draw may still go ahead, this will be at the agent’s discretion and based upon whether the number of paid entries is sufficient.

When entering into each competition the entrants have read and accepted the following terms and conditions:
All entrants are solely and completely responsible for providing and maintaining the promoter with accurate contact details.
The promoter will not be liable for any failure or inability to make contact with any entrant due to any mistakes or inaccuracies in the contact details provided by the entrants.
The entrants and the promoter recognise that the promoter may use contact details and other data including personal data as defined by the Data Protection Act 2018 supplied by the entrants to the promoter to administer the website and conduct the competition according to these Terms and Conditions.
The entrants and the promoter also recognise that the promoter may also disclose this information to relevant third parties for the purposes of the prevention of fraud, money laundering, legal or other financial or regulatory reasons.
The competition is operated only by the promoter. The competition is open for entry to all persons aged 18 or over excluding the promoters, their families, professional advisors or anyone else involved with the development or operation of the website or conducts administration of the competition in any way.
All entrants accept that their payment for each entry to answer the question and therefore entry into the competition does not guarantee in any way that they will win the prize. The Promoter does not in any way guarantee the value of the prize or it’s condition and road worthiness at the time of exchange with the winning entrant.
Only the completed entries which contain the correct answer as in correspondence with the promoter’s answer will be entered into the competition.
As a condition on entering the competition, entrants must ensure that, by doing so, they do not contravene any laws in their country of residence. The promoter will not be liable in any way if an entrant enters the competition unlawfully. The entrants and the promoter recognise that the competition, its administration and all associated activities are governed by Republic of Ireland Law and the promoter and entrants recognise that the county or high courts of Republic of Ireland shall have exclusive jurisdiction in the event of a dispute arising out of the competition or its administration. By entering any giveaway entrants warrant that any information provided by them shall be accurate, current and true. The promoter reserves the right to disqualify an entrant if there are reasonable grounds to believe that the entrant has acted outside of these terms and conditions.
All entries will become the property of the promoter on receipt and will not be returned. Should any competition conclude early either a cash prize will be offered that is equivalent to 70% of the entry fees taken for that particular competition.
On answering the question, the entrant recognises that they must exercise knowledge, judgement and skill to give the correct answer.
The maximum number of entries per entrant per competition is 10 although the promoters reserve the right to amend this as they deem suitable. The promoter is not liable in any way for the valuation and makes no representation or warranty in respect of its accuracy.
To conclude an entry into the competition, an entrant will be asked to provide their contact details (including postal and e-mail addresses and a telephone number) and card payment details (for entry fee only). Once the entry is submitted, the entrants card payment will be electronically approved.
When the maximum number of entries or the closing date is reached, the competition will close; however, the promoter reserves the right to extend the closing date by up to 4 weeks at their discretion.
All entries to the competition are final and no refunds shall be made at any time or for any reason, except in the case of entries submitted after the closing date or if the promoter cancels the competition.
The promoter’s decision is final and no correspondence will be entered into about the result of the competition following the determination of the winner as described above.
Every entrant agrees that the typical requirement under the consumer protection (distance selling) regulations 2000 for goods and services ordered online to be supplied within 30 days will not apply to this prize competition.
CLOSING THE COMPETITION
If the number of entries in each competition does not exceed the maximum number of entries at the closing date, the competition will either close and the proceeds will either be considered sufficient to award the Product as a prize at the sole discretion of the promoter, or the remaining funds will be awarded as a cash prize to a winner after the deduction of related expenses.
The promoter will be entitled to retain 35% of the entry fees to cover administration. The remaining balance following the deduction of 35% plus expenses (marketing, payment solutions, legal fees, website hosting) is “the prize fund”. The prize fund will then be offered to the winning entrant. The prize fund will also be used as the prize in the event of anything happening to the given prize that we are unable to offer it as the prize (for example if the car that is the prize has been stolen or damaged during the competition).
If a winner has been selected in a given competition yet has not been able to be contacted via e-mail, phone, Facebook or post having used the contact details submitted along with their entry, then the promoter reserves the right to again select a new winner, who will then have 7 days to accept the prize following the same routes of contact as the original winner. The original winner will have no claim to the prize after the alternate winner is selected.
SELECTING A WINNER
The winning entrant will be selected live on Facebook using Googles random number generator.
All relevant details of the draw date and time will be confirmed once the competition has been concluded via Facebook and posted on our website. This decision will be made within 48 hours of the close of the competition.
There will only be one winner per competition unless otherwise stated.
After the competition is completed and awarded successfully, the prize will be transferred by the promoter to the winner of the competition using the V5 document for each car or a receipt for the product if there is one. This must be completed before the car is handed over. The winner is immediately responsible for taxing and insuring the vehicle upon successful handover with the promoter having no liability for the vehicle thereafter.
The promoter owns any prize offered from the time the competition is live until successful handover is completed. The promoter does not imply or give any warranty or accept any valuation to the prize. The entrant must make up their own decision through their own enquiries and legal advice before entering the competition. The prize will only be that as awarded at the time of the draw, no alternatives to the specific prize will be offered under any circumstances.
The winner will be required to provide proof of identity and proof of entry into the competition at the time that the prize is collected. We also require use of a winner’s photograph for our website.
OTHER FACTS FOR CONSIDERATION
The winner also agrees upon acceptance of the prize that they are required to have a photo or video taken for promotional purposes, both directly after their win and in any future promotional material.
The promoter reserves the right to cancel the competition at any time either before or after tickets have been sold. If the competition is cancelled, the promoter will return any entry fees paid to each entrant. Where the entry fee is returned, the promoter shall have no further liability to the entrant or to any other person.
Save for death or personal injury the promoter will not be liable for any loss (including economic loss) suffered to or incurred by any person or property as a result of any act or omission of the promoter, nor will their agents in developing, planning and administrating the competition, distributing the prize to the winner or following the distribution of the prize; The promoter accepts no liability for errors or omissions contained within the prize details, description or specification or any other part of the website. It is the responsibility of each entrant (and in particular the winner) to satisfy him/herself as to the accuracy of any such details and/or any content of this website.
The promoter will not be liable for any loss suffered by an entrant as a result of incomplete entries or failed computer communications or for any loss suffered as a result of use of the website. The promoter does not accept any responsibility for entries which they do not receive due to failures in computer systems, other malfunctions, high internet traffic, hardware failure, software failure, server faults or any other reason.
These competition rules shall not create or be construed as creating any form of contract, joint venture or other agreement between any entrant and the promoter.
The promoter reserves the right to amend these terms and conditions at any time. Any changes will be immediately published on the competition home page.
